Mental Health Match, Inc. takes your privacy seriously. We are committed to protecting the privacy and security of the personal information we receive and collect from you. We also believe in transparency and are committed to informing you about how we treat your personal information during your use of and access to our online mental health provider information service, which includes a "Matching Service" for Consumers and a "Listing Service" for Therapists, along with all associated features and functions (the “Services”).

This Policy, together with the Terms of Use (Consumers) or Terms of Use (Therapists), as applicable, governs all Users of the Service offered at mentalhealthmatch.com (the "Site").

This Policy does not apply to information collected by us offline or through any third party, including any third party application, website, or content (including advertising) that may link to or be accessible from this Site.

Consumer(s):

Anyone who visits the Site, but is not registered as a "Therapist" with the Listing Service through the Site.

Therapist(s):

Psychiatrists, psychologists, counselors, clinicians, therapists, clinical social workers, and other similar professionals, such as mental health nurse practitioners, who (1) are duly certified or licensed and in good standing under applicable state law to provide mental or behavioral health services and (2) have registered with the Listing Service through the Site.

Listing Service

The component of the Services offered exclusively to Therapists that enables them to be listed in the Mental Health Match database, thereby advertising their professional services, enabling professional networking and communication through the Site.

Matching Service

The component of the Services offered exclusively to Consumers that is designed to identify Therapists who may potentially meet Consumers' criteria.

We may change this Privacy Policy at any time, and from time to time, in our sole discretion without notice to you by updating this posting. You should periodically review this Privacy Policy carefully in order to make sure that you are aware of the most current terms and conditions for the use of the Site. By continuing to use or access this Site, you agree to be bound by any such revisions.

Information We Collect about You when you visit the site

In order to provide the Services that are requested of us, we need to collect or request certain information from Users.

Consumers: As described in more detail below, we collect information about you anytime you visit our Site, access our content, or use our Matching Service.

Therapists: As described in more detail below, we collect information about you when you register and use our Listing Service.

None of the information we collect through this Site constitutes "Protected Health Information" as that term is defined by the Health Insurance Portability and Accountability Act of 1996, the Health Information Technology for Economics and Clinical Health Act, or the regulations implementing these laws found at 45 C.F.R. Parts 160, 162 and 164.

Registration

Consumers: Consumers do not register to use the Matching Service or browse the Site.

Therapists: Therapists must register with the Site in order to use our Listing Service and make use of all available features of that Service. During registration, you will be required to provide contact information, including your name, email address, and password. We also require that you provide your credentials, license information, and fees in order to make your profile available to Consumers and the functionality and features we provide to them.

As part of the registration process or at any time you choose to edit your profile, you have the option of providing additional information as part of your account profile, including information about your background, availability and credentials, a photograph of you and/or your office, your approach to therapy and specializations, information about yourself (e.g., description of what it is like to work with you, reasons why you became a therapist, etc.), and a short video providing information about you and your services.

Unless you are participating in a free trial, use of the Listing Service is not free and you will be charged certain fees associated with your use and access to the Listing Service. In order to process those fees, we, or a payment processing partner, collect information such as your full name, email address, postal address, telephone number, financial account and routing information, debit or credit card number with expiration date, or other information, from you.

Survey Questionnaires

Consumers: Anytime you use our Matching Service, we require you to complete a survey questionnaire designed to determine your criteria for a therapist and the services you may be seeking. Through the survey, we securely collect information about you, including age, gender identity, zip code, preferences for therapy services, goals for therapy services, types of therapy services of interest to you, information about the traits you would like your therapist to have, and information regarding your budget for therapy services, including whether you have insurance and if so the name of your insurance provider and insurance plan name. We may store a URL that allows you to return to the Matching Service to see your results without having to retake the survey questionnaire.

Therapists: As part of creating your profile for the Listing Service, you have the option of answering additional questions that will enable us to include your listing in results generated from our Matching Service to Consumers. At your option, we will collect information from you about your practice and training, the types of services you offer (e.g., modalities of therapy offered), general characteristics about the types of clients you serve (e.g., gender, age ranges), information regarding the insurances you accept and your fees, and information about your personal traits, beliefs and perspectives.

Communications with Us and Others

Consumers: When you use the Contact Therapist feature of the Matching Service, we collect your name and email address as part of that process, along with other information you submit through the online contact form. If you authorize us to contact a Therapist on your behalf, we will send the information you provided on the contact form, and your survey responses, to the Therapist via a standard email, and the contents of those emails will follow standard internet protocols and may be stored on various third party servers over which we have no control. We do not store the content of those emails beyond the transitory period of time required to send the email.

Therapists: When you send us an email, submit an online form to contact us, use the Site to invite other therapy providers to join the Mental Health Match network, or communicate with us via the Site through other means, we may use those communications in order to process your inquiries, respond to your requests, and improve our Services. We may use your email address to communicate with you about new or additional features of our Listing Service or request feedback regarding our Site and our Services.

We may also use your registered email address to provide you with significant announcements about functions of our Services, about your Therapist account, about fulfillment of a specific transaction you have requested, or about other significant developments that may affect your use of the Listing Service. You cannot opt out of this kind of email, but can stop receiving such email if you cancel your user account.

Blogs and Other Public Content

Therapists: The Listing Service may allow you to contribute to one or more blogs or communicate publicly with Users by means of certain online social media and posting functions.

If you choose to disclose your identity to third parties using any Listing Service function or Site feature that may be viewed by the general public or other Users, you do so at your own risk. Mental Health Match is not responsible for the privacy, security, or confidentiality of any information, personally-identifiable or otherwise, that you may choose to communicate or exchange using functionality of the Site that is available for public viewing.

Any information or any materials you contribute for such purposes are considered to be your “Public Content.” Public Content must be content and information that you have a legal right to disclose and transfer and must not violate any other person’s privacy or intellectual property rights.

Newsletters and Announcements

Therapists: Mental Health Match may use your email address to provide you with email newsletters and/or announcements. If you do not wish to receive these kinds of communications, you can unsubscribe from newsletters and announcements by opting out at the link provided on each email, by return email, or by changing your contact information on file with the Service.

Feedback to Mental Health Match

Mental Health Match may have feedback functionality on the Services that allows you to submit comments or suggestions. Mental Health Match may collect your name or username, if applicable, and email address in order to follow up with you or thank you for a suggestion.

Anonymous Data

Mental Health Match may track the Services to analyze trends, administer the Services, track your actions and use of the Services, record transactions, and gather information for aggregate use. Such analysis is not linked to your personally identifiable information.

Mental Health Match may share aggregated usage information with its partners, advertisers and Therapists. This aggregated information is not linked to any personal information that can identify any individual person.

Automated Information Collection

Our Site uses Google Analytics and may use other similar technologies, (the “Analytics Technologies”) to collect and process certain information about you and your use of the Site. The information collected by the Analytics Technologies is statistical data that does not include personally identifiable information about you, and we do not maintain it or associate it with any personally identifiable information we collect in other ways or receive from third parties. Google’s ability to use and share information collected by Google Analytics about your visits to the Site is restricted by the Google Privacy Policy located at https://google.com/policies/privacy/.

Our web server and/or the Analytics Technologies may collect and store the following information about you: the originating name of the domain from which you access the Internet; the date and time you access the Site; the pages of the Site you visit or the services you access on the Site; the Internet address of the website from which you linked directly to the Site; the type of device, device ID, operating system and web browser you use to access the Site; the search engine and key words used that brought you to one of our sites; and the location of the device used to access the Site. This information is collected automatically. We use it to improve the Site by tracking the number of visits to the Site, the most popular times of day and sections visited, and the range of devices and browsers most commonly used to view the Site. We do not sell any of this information to third parties.

Cookies

We may use “cookies,” which are small files stored on your computer’s hard drive that are used to store and track personal information. Cookies are used to (a) remind us of who you are in order to deliver you better service; (b) estimate our audience size by determining repeat usage of the Site to help target advertisements based on user interests and behavior; and (c) measure certain traffic patterns for use as a research tool to understand how our users’ habits are similar or different from one another.

What Information Do We Share and With Whom?

We do not rent or sell your information to third party marketers. As permitted by law, we may share your information with our employees, accountants, attorneys, and agents. Meta Pixels. We may use the Conversion Tracking Pixel service provided by Meta Inc. ("Meta Pixel") in order to receive anonymized data about those visitors to our Site who also use Meta products such as Facebook. This service enables us to measure the effectiveness of our social media advertising. We do not collect personally-identifiable information from you as a result of the Meta Pixel. Hotjar. We may use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device's IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf. HOW WE PROTECT YOUR INFORMATION

We maintain reasonable and appropriate administrative, physical, electronic, and procedural safeguards to protect your information. When you make use of a registration or contact form via the Services, such as our survey questionnaires, that information is encrypted and protected during transmission through the Internet using Secure Socket Layer (SSL) technology (which is usually represented by the presence of a lock icon in the locked position near a web address beginning with “https://”).

We also anonymize and aggregate Consumer survey responses so that those responses no longer qualify as personally identifiable information. The anonymized and aggregated survey responses are kept separate from personally identifiable Consumer information.

No data transmission over the Internet or data maintenance system can be guaranteed to be 100% secure. As a result, while we strive to protect your personally identifiable information, we cannot guarantee or warrant the security of any information you transmit to or from our Site, and you do so at your own risk. We are not responsible for any circumvention of any privacy settings or security measures we provide. We make no warranties, express, implied or otherwise as to the ultimate effectiveness of these reasonable and appropriate safeguards.

The safety and security of your information also depends on you. For Therapists who have registered to create an account and password to access the Listing Service, you are responsible for keeping this password confidential. Do not share your password with anyone else.

OTHER IMPORTANT INFORMATION

Requesting Access or Changes to Personally Identifiable Information

If you have any questions about the personally identifiable information we may retain, you may contact us using the Contact Information provided below. Upon your request, and upon verification of your identity, we will allow you to review your personally identifiable information under our control, if any, as well as information about the ways in which that information is being used and disclosed. We only collect personally identifiable information for purposes of providing you with the information or Services that you request from us and the support of those Services. We will use commercially reasonable efforts to ensure that personally identifiable information we may be using or disclosing is accurate and complete. If you are able to verify that your personally identifiable information is inaccurate or incomplete, the information will be amended as appropriate. We will use commercially reasonable efforts to respond to any request and update your personally identifiable information, if necessary.

Retention and Removal of Information

We will retain your information as needed to fulfill the purposes for which it was collected, comply with our legal obligations, resolve disputes, and enforce our agreements. Upon your request, we will make commercially reasonable efforts to remove all your personally identifiable information from our records. If you would like to request that we remove your personally identifiable information from our records, please contact us using the Contact Information provided below.

Therapists may delete their information through Account Settings, or request that we delete their account.

Location and Storage of Information

We control and operate the Site from locations in the United States of America. If you are located outside of the United States and you choose to provide information to us, then by using the Site and any Services contained therein, and by consenting to the terms of this Policy and submitting your personally identifiable information to us, you consent to the transfer of your personally identifiable information to the United States.

Protecting Children

We are committed to protecting the privacy of children. This Site is not intended for use by children under the age of 18 without specific and express parent consent. We do not knowingly solicit or collect personally identifiable information from any child under the age of 18. If you are under the age of 18, do not use or provide any information on the Site or provide us with any information about yourself, such as your name, telephone number, email address or any screen name or user name you may use. If we learn we have collected or received personally identifiable information from a child between the age of 13 and 18 without verification of parental consent, we will delete that information. We can remove any content or information you post on Mental Health Match if we believe that it violates this Privacy Policy or the Terms of Use (Consumers) or Terms of Use (Therapists), as applicable, of Mental Health Match. You will not use our copyrights or any confusingly similar marks, without our written permission. If you collect information from Mental Health Match Consumers or Therapists, you will obtain their consent, make it clear you (and not Mental Health Match) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it. You will not post anyone's identification documents or sensitive information on Mental Health Match.

Governing Law; Arbitration

This Policy and any disputes related thereto shall be governed by and construed in accordance with the laws of the State of Oregon without giving effect to any choice or conflict of law provision or rule (whether of the State of Oregon or any other jurisdiction). Please refer to our Terms of Use (Consumers) or Terms of Use (Therapists), as applicable, for more information on governing law and arbitration of disputes. This Privacy Policy is subject to and incorporated by reference by our Terms of Use (Consumers) and Terms of Use (Therapists), the terms of which shall prevail in the event of any conflict.
